news coverage, starts right now. this is ktvu mornings on 2. >> and good morning. welcome to mornings on 2. i'm brian flores. >> i'm claudine wong. it's thursday, we want to start with breaking news we first reported at 4:30 this morning. the investigation is underway in a deadly police shooting in walnut creek. it happened hours ago and we are on creek side drive near 680 with the circumstances that led up to the shooting. >> reporter: police just wrapped up their latest briefing about 15, 20 minutes ago. we are getting new details, we have learned there are now multiple officers involved in this incident which wound up with an parent domestic violence suspect dead. investigators are still onto scene. the presence of police and sonoma -- contra kosta county

deputies has decreased but we are learning that incident appears to have happened behind that brick fence you can see in the distance there. police say this may have started as a possible domestic violence incident that ended in gun fire. one suspect dead, nobody else hurt we have learned. we have learned the initial call came into 911 from a woman caller shortly before 3:15 this morning. >> we received a 911 call, transferred from the fire department at 3:13 this morning. there was screaming on the line. officers were dispatched and arrived with in minutes. we received a radio transmission at 3:19, the shots had been fired. >> reporter: so far police are not releasing the suspect's name and there is no word on why the officers fired in this case or whether that suspect had a weapon. we have also heard that the district attorney's unit has been called in. we have seen the da's,

investigators in the scene. that is common after an officer involved shooting. police also say there are no suspects outstanding. we are again still waiting for more details about this incident in particular we want to learn more about the male involved in this incident who was apparently shot and killed by walnut creek police and if he threatened the officers or if the officer has to fire to stop him from hurting another person. he with will bring that when we learn them. we are live. ktvu. >> police are trying to find if alcohol was involved in a fatal crash in haywood. a ford mustang broadsided the driver of a nissan last night. the pick up driver, a man in his late 50s died at the scene. a man is recovering after being shot in san jose over

night. police found the victim at about 8:40 last night. he was taken to the hospital and is expected to survive. investigators say the shooting does appear to be gang related. >> new this morning a person was hit by an ambulance and seriously hurt in san jose. it happened around 3:00 this morning. police say the ambulance was driving through a green light when a person wearing dark clothing walked in to the street. also a police chase in pasadena ended in a crash that killed an 11-year-old. authorities were pursuing an suv with when the vehicle hit another suv on christmas night. two people in that second vehicle were killed including the child from the peninsula. three other residents were also in that van and they had serious injuries. investigators are trying to determine if the suspects in the first suv are connected to an earlier gang shooting in

which a stray bullet killed a veteran tech with the los angeles county sheriff's department. >> a team of fire officials will look into an early december crash that sent firefighters to the hospital. the accident happened december 1st. three firefighters investigating a noninjury crash were struck by an out of control car in highway 24. the fire chief wants to review policies and procedures in hopes of preventing anything like that from happening. the district has currently put in new procedures. several new driving laws go into effect starting on january 1st. we are in san jose to tell you about some of them. >> reporter: right now if you get pulled over by police you have to show written proof of insurance but starting on january 1st, you can show that proof by using your smart phone or tablet. >> i have not heard of that but that would be great. then i don't have to worry

about its condition in my car or whatever. i would love to be able to do that, have the picture of my insurance and be able to show that instead. >> reporter: another new law involving control phones makes it legal to send and receive texts with hands free device that are powered by voice operated software. here is another new law, if you are driving a car with a clean air vehicle sticker you will be allowed to use toll lanes like the ones on 680 and 237. >> set up for people to buy them, that's good. >> reporter: here is an interesting law. self driving cars will be allowed on public roads as long as a licensed driver is in the driver's seat. that law was written by a google co founder who touted the car saying it would help transportation issues. there is also support for them saying eventually they could

it's close to traffic so they are running a break. here is a look at maps where 680 southbound, actually we will go to 101 in san francisco. you can see we have traffic flowing nicely in both directions. finally a look at maze. you can see traffic also flowing very well there on the far right hand side of the screen. let's check in with mark. >> good morning to you. we are taking a live look outside. you can see in the south bay and san jose cloud cover to deal with. the key headline, we get a break-in the rain. no rainfall expected in the bay area. you can see even the sierra gets a break and all i can find is a few spotty showers, very light. as far as current temperatures, just updated for the 7:00 hour it has cooled off one degree in fairfield down at 39 at last check. oakland in the mid40s. sfo at 50 and san jose right about 43. here is the forecast for today. more cloud cover this morning,

temperatures in the upper 30s to the upper 40s. then in the afternoon partly cloudy, we will strip away the clouds, those readings in the low to mid50s. we have another weather system off shore that could produce a few showers. especially by friday evening. for today we just have the big batch of cloud cover moving in and that will be the source of some of the overcast. it does slowly thin out into the afternoon. here is a look at numbers, san francisco 53, fairfield 51, brentwood about 51, san jose maxes out about 54 and san mateo53, here is a look ahead. the five-day with the weekend always in view, rapidly approaching and we do bring in the chance of a few showers by friday. a slight chance during the day but a better bet late friday afternoon in to the evening. showers could linger into saturday morning, especially until eight or nine and then dry weather for sunday that will take us into new year's

with just a few extra clouds. in a few we will look at the lake tahoe forecast. >> okay. we will see you then. a portion of the great highway is still closed this morning because of flooding. yesterday's heavy rain left pools of water on the road closing parts of the southbound lanes. there is no estimated time for when the road will reopen. emergency repairs seem to be holding up to a levee. sandbags were stacked after levees failed on sunday. they were inspected yesterday, crews say it's still working. seven homes were damaged by the flooding. long term repairs are set to begin next year. the storms in the bay area have been good for the water supply and for the snow pack in the sierra. state water officials say the water content is 146% of normal for this time of year. the snow pack provides a third of the water supply for homes, farms and industries in california. >> a man is arrested for dousing a woman with alcohol and setting her on fire at a

capitol. he is trying to get republican support for the latest democratic plan. they got back to work about 15 minutes ago and are considering the president's offer to raise taxes on households making $400,000 or more a year. even if it passes the senate he is concerned about the house where he will need about 30 republicans to cross party lines. the house speaker said he is not making members of the house come back from their break without a 48 hour notice on a vote. in the last -- >> american people i don't think understand the house is operating without the house of house. its being operated with a dictatorship of the speaker. >> reporter: on top of this the treasurey department said the united states will hit its debt ceiling on monday and unless it takes extraordinary measures the country could default on some of its payments. we are expecting to hear more

from senate leaders today we will have more in the next update. >> thank you. the east coast is being pounded with more powerful storms and that's causing problems at airports across the criminal airlines have canceled hundreds of flights because of the storm. heavy snow has been falling in pennsylvania, upstate new york and some new england states. thousands are now stranded at airports across the country. >> you can't change it so you take it for what it is and make the best of a bad situation. >> in the bay area dozens of flights to the east coast were also grounded. bay area airports have also had days of delays because of rain here and with more rain expected on friday the local flight delays could continue through new year's. >> a hospital is set to reopen today after it was forced to close because of sandy. 300 had to be evacuated from the medical center at the time of the storm. the hospital received $150 million in federal aid.

some outpatient services have already been back in operation since last month. and a vigil was held for two new york firefighters shot to death on monday night. dozens of people turned out in the community of webster new york. they braved frigid temperatures to take part in the memorial. the suspect set his house on fire and then started shooting at random before killing himself. two others were hurt and are still in the hospital. former president george hw bush is in guarded condition at the hospital this morning in houston. a family spokesman said the 88- year-old is a alert, he is talking with medical staff and he is surrounded by his family. he was moved to the intensive care unit on sun and has been in the hospital since late last month. >> it'll put you in the icu because things are going well. we are hoping that the medicines and treatments can help him turn it around. >> he has a high fever and is

now on a liquids only diet. his wife and his sons have all been frequent visitors at the hospital. >> in overnight news a southern california woman is in the hospital after police say a man set her on fire. a witness said that a man walked into a store, bought alcohol, put it on the woman who was sleeping on a bus bench, lit a match and then ran. the witness chased him and called the police. the suspect was arrested. he could face murder charges if the woman doesn't survive. a petition against a controversial kansas church is growing. more than 250,000 have signed a petition asking the white house to legally recognize the church as a hate group. the church is known for protesting at military funerals. they claim united states military deaths god's punishment for tolerating gays. >> russian president said he will sign a bill banning americans from adopting russian

children. the government approved the proposed ban in response to a law calling for sanctions against russians who have violated human rights. more information now on the release of 1200 secret files disclosing sexual abuse in the boy scouts. the times published the database of the alleged abusers online after a judge ordered them handed over. we talked to one of the victims josh solomon and he brought his boy scout uniform he wore when he was 12. he said the scout master for his group molested him during camping trips in 82 and 83. >> 30s, veteran, nobody wants to admit they were powerless to stop something like this from happening. >> his abuser served time in

. happening now, pg&e crews have found the source of a gas leaka affecting a brentwood neighborhood. alex savage is live where crews have been working all night. >> reporter: good morning. i just talked to one of the people evacuated because of the gas leak in that neighborhood. she said it was nervewracking when firefighters came knocking on the door of her home. this home and the others next to it remain evacuated. the order is still in place but the good news is workers have controlled the gas flow and are running a bypass to keep gas

service on in this neighborhood. crews repairing a broken two inch underground gas line. overnight crews dug up quite a bit of sidewalk trying to figure where the gas was leaking from. this situation gana round 6:00. that's when neighbors reported the smell of gas in this area. people here were ordered to stay inside their homes. one woman who was evacuated said she was anxious when firefighterred ordered her to leave last night. >> the first thing was that the san bruno thing and stuff. i -- then once i knew there was only like three houses that were vacanted our -- i knew it wasn't that bad but still, you know, i had to be one that was evacuated. >> reporter: she said she went to stay with her mom who lives nearby. she is hoping to get back home soon but won't be able to until this broken line can be repaired. pg&e did say early this morning

that the work may not be finished until this afternoon. we have a call in at that point to a pg&e spokesperson. we haven't heard back with you are hoping to get the update on when the evacuation order will be lifted. we are live in brentwood. ktvu channel 2news. >> and we are learning more about the breaking news on a deadly police shooting in walnut creek. we have been told that several officers were involved in that shooting. it started with a domestic disturbance call to 911. police are not releasing the name of the suspect or why officers opened fire. as protocol the da is now investigating the incident. in the next half hour we will get a live report from the scene. vandals targeting an area of east oakland drawing complaints. early yesterday morning suspected vandals smashed windows of a hair salon. they also smashed windows of a

nearby empty store front and a parked van. the area has been the center of crimes and now business owners are writing city leaders to ask for more police protection. >> bail at two million dollars for a woman accused in a fatal hit and run crash. the 23-year-old made her first court appearance yesterday. she is expected to enter a plea next week. she was drunk when she hit a group of people walk agriculture long a road near twin peaks. >> 56-year-old was knocked down a hillside and killed. >> this case is a case that will be handled very aggressively. >> the entire family is destroyed by what happened. i think it's fair to say that their man concern is for the family. >> the lawyer said her client has never been in trouble with the law and was studying criminal justice to be a police officer. more people drove drunk over the holiday this this

year. 1, 170 people were arrested for dui's, that's compared to 980 last year. 39 people died compared to 14 from the same time last year. police did a series of checkpoints in hopes of curbing drunk driving during the holidays. >> san francisco police are look for more potential victims of three shoplifts suspects. take a look, on december 20th the three went into two stores on california street near laurel heights. investigators say the women put items in their bags and then they walked out. those three are under arrest on suspicious of shoplifting but police are looking for more information on them. police also investigating the damage of several vallejo high school buildings. it happened late tuesday night or early wednesday morning. a campus security guard found a broken junction box on a portable classroom. the wires wires were also stripped. since the buildings were damaged, the dollar amount of

thousands of toys, and other gifts have been going in to the community from all over the world. officials say that they are deeply grateful but they can't manage so many items. they say once they process all of the gifts they are going to let the public know the best way to help those affected by the shooting. in response to the connecticut school shooting a guns for groceries exchange program in los angeles was held earlier than planned. it created long lines of people and cars waiting to turn in their guns to officials yesterday. the event was first scheduled for may. in return for those guns the people received a 100-dollar gift certificate to ralp h's. more than 2,000 guns were collected. in new york city a newspaper is drawing criticism for publishing the names and addresses of gun permit holders. they published a database showing the names and

it was scariest moment. >> reporter: police say it started a fight got out of control drawing in at least 20 juveniles. >> all the groups jumped in and they all started fighting. >> reporter: even after police and security jumped in some of the teens kept fighting. >> the police caught maybe three of them and then they all came here and did it a second time. >> reporter: that's when several people inside the mall heard what they thought were gun shots. >> we all heard it because we were -- everybody was coming to seat second fight. . >> reporter: not everybody. >> something similar to gun shots. we don't know if it was gun shots but it sound like shots. >> reporter: police say they have ruled out any gun fire. they believe the sounds of large signs falling over may have led people to report shots fired. >> you start thinking the worst thing that can possibly happen like i just imagine someone with -- with a gun or just -- someone coming to the store and threatening us.

. and the markets headed in a down direction. that's a look at the big board down 86 points, people not feeling good about the fiscal cliff. senate majority leader this morning said it looks like that is where we are headed, certainly investors don't like to hear that. the white house has said that the president has made separate calls to congressional leaders as he heads back to dc to try to deal with the deadline. this morning the labor department reported a better than expected report on the number of jobless claims, 350,000 people filed for first time unemployment benefits last week. that's down 12,000 from the week before. most economists expect that to hold steady from the week before but they warn that decline may be blown up because government offices were closed monday and tuesday. and more sign that the economy is improving. the commerce department said sales of new homes rose 4.4% in november. americans bought new homes at the fastest pace in more than two and a half years.

they said demand was up more than 15% from a year ago. consumer confidence has fallen because people are so worried about that fiscal cliff. the index has hit the lowest level since august. the concern is over tax increases and government spending cuts set to take effect january 1st if the white house and congress can't reach a deal. >> toyota is forecasting sales of nearly ten million vehicles next year and it's expected to reclaim the title of world's largest automaker. the company is on pace to sell 9.7 million this year which would put it ahead of gm. it would also be up 22% from last year when it was unable to meet demand arch its factories and suppliers were hurt by the quake, tsunami and natural disasters. and toyota will reportedly play $1.1 billion to settle lawsuits over car that accelerated unexpectedly. toyota recalled 14 million

vehicles around the world. the settlement still needs a judge's approval and toyota faces lawsuits over injuries and deaths the problem. wells fargo doesn't have to pay $203 million to customers after a united states appeals court overturned a decision. the first ruling was ordered at the san francisco based bank changed the order of debit card purchase postings. a customer sued after they started posting the biggest purchases first, that could force customers to pay overdraft fees on smaller buys. >> amazon is a stock to watch it looks like that stock is down just under 1%. stock fell almost 4% yesterday. the wireless service is being blamed for the outage of netflix on christmas day. they still can't explain what happened. they are earning high marks

i did just check with the police officer here on scene. he said that these three homes right near where this repair work is taking place remain evacuated as they worked to repair a broken gas line. workers have been able to control the gas flow out here and they are using this bypass to keep gas service going in this neighborhood. the situation started about 6:00 when neighbors called the police to report the smell of gas in this care. people were ordered to shelter in place. it took crews material hours to isolate the leak. one woman who was evacuated said she panicked when a firefighter knocked on her door. >> i opened up the door and he said got a gas leak, we are evacuating i'm like i have three dogs, what am i going to do? he said we are just worried about the humans right now. >> joy said she went to stay with her mom who lives close by

3:13, there was screaming on the line, officers were dispatched, and arrived with in minutes. we received a radio transmission at 3:19 that shots had been fired. >> reporter: at this point police aren't releasing the suspect's name. there is no word on why the officer or officers involved fired or if the suspect had a weapon. there were multiple officers on the scene and that aside from the suspect nobody else was hurt. chopper 2 was overhead earlier this morning trying to give us a better view into the apartment complex where it happened. a crime scene van moved in to the area here about an hour ago and we have heard that the district attorney's unit has been called in. that's not unusual in the cases of officer involved shootings. police say there are no suspects outstanding. we are hearing there will be another briefing later on this morningw.
